  • MailerLite reserves the right to immediately terminate the Affiliate's participation in the Program, withhold any unpaid Commissions, and cancel any pending payments if the Affiliate is found to be in violation of this section, as per these Terms.

3. MailerLite Rights and Obligations

Subject to MailerLite’s approval of your application and continued compliance with these Terms, MailerLite agrees to:

3.1. Affiliate Tools and Tracking

MailerLite will provide you with a unique code “Affiliate Code”, tracking-enabled links (“Affiliate Links”), and access to creative materials, which may include banners, logos, or pre-approved content. These materials are to be used exclusively to promote MailerLite via your authorized Media (e.g., websites, email newsletters, or social platforms).

3.2. Commission Eligibility
  • MailerLite agrees to track and compensate you for Affiliate Conversion.

  • MailerLite is not obligated to pay commissions for accounts that were referred outside the allowed tracking conditions, from the same IP/device as the affiliate, or through other manipulative means.

3.3. Tracking Disputes
  • MailerLite uses its internal tracking system to determine whether a referral qualifies for a commission. In the event of discrepancies between MailerLite’s tracking records and third-party tools used by the Affiliate, MailerLite’s data shall prevail.

  • Any commission disputes must be submitted in writing with full details within thirty (30) days of the payout. Failure to dispute within this period constitutes acceptance of the payout amount as final.

3.4. No Liability for End-User Payments
  • MailerLite’s obligation to pay Affiliate commissions is contingent upon receipt of actual payments from the referred customer. If a customer fails to complete a transaction or reverses payment, MailerLite has no obligation to compensate the Affiliate.

  • MailerLite will not be liable to you with respect to any failure by you or someone you refer to use Special Links or incorrectly type your Affiliate Code, including to the extent that such failure may result in any reduction of amounts that would otherwise be paid to you pursuant to these terms.

  • MailerLite has the right to monitor your website or social networks at any time to determine if you are following the terms and conditions of this document.

3.5. Monitoring and Cooperation

3.5.1. MailerLite reserves the right to:

  • Audit or monitor your Media at any time to assess compliance with these Terms;

  • Require changes to content, placement, or tracking methods as a condition of continued participation;

  • Suspend commissions or deactivate accounts found in violation;

3.5.2. You agree to cooperate fully with any compliance request or investigation.

3.6. Fraud Investigation Rights

We reserve the right to review all transactions for possible fraud. During investigation of potential fraud or Terms violations, we may withhold payment of any balance for up to 180 days while we investigate and verify compliance with these Terms and applicable laws.

4. Commission and Payment

4.1. Commission Eligibility

Subject to these Terms, you are eligible to earn commissions for each Affiliate Conversion generated through your valid Affiliate Link. An “Affiliate Conversion” is defined as a purchase that satisfies all of the following:

  • The referred user is a new customer who has not previously signed up for MailerLite services;

  • The end-user clicks your Affiliate Link and is tracked by our system as the final referring source within the allowed referral window (45 days) (“Referral Window”);

  • The user is a real, unique person, not a bot, duplicate, crawler, fraudulent account, or artificial traffic source;

  • The user completes all required onboarding fields and selects a paid MailerLite plan during the same session or within the Referral Window;

  • The user’s subscription remains active and is not cancelled or refunded during the eligible evaluation period (typically 45 days);

  • The purchase is not determined by MailerLite to be fraudulent, invalid, or a duplicate.

MailerLite is under no obligation to pay commissions for any actions that fall outside of these parameters, including, but not limited to self-referrals, referrals from your own device or IP address, or automated / bot activity.

4.2. Commission Structure

You will earn a 30% commission on the initial purchase of a paid MailerLite subscription (monthly or annual), as well as 30% on all subsequent recurring (lifetime) subscription payments from that same customer, provided they remain active and compliant.

4.3. Referral Attribution & Tracking

MailerLite uses a last-click attribution model within a 45-day Referral Window. Commissions are awarded only when your Affiliate Link is the final referring source before conversion. You acknowledge that all referral tracking is determined solely through MailerLite’s internal systems and tracking tools. If tracking is blocked, disabled, overwritten, or tampered with, no commission shall be awarded.

4.4. Payment & Payout Conditions

4.4.1. MailerLite will process commission payouts only when both conditions are met:

  • Your account balance exceeds 100 USD;

  • You have referred at least two (2) paying customers that are active at the time of the payout request and meet the conditions of the Affiliate Conversion.

4.4.2. Affiliate Commissions are paid solely via Tipalti. To receive commissions, you are required to have a Tipalti account that is fully capable of accepting commercial payments. MailerLite will not be able to pay commissions to you if your designated Tipalti account cannot receive commercial payments. MailerLite will not send checks, cash, make personal payments, or credit commissions to any of your other debit or credit accounts.

4.4.3. It is your sole responsibility to provide and maintain accurate, current, and verified payment information for your Tipalti account. MailerLite is not responsible or liable for any failed, misdirected, or delayed payments resulting from inaccurate or outdated payment details provided by the Affiliate.

4.4.4. MailerLite reserves the right to deduct or reverse previously paid commissions in the event of chargebacks, fraud, subscription cancellations, tracking errors, or refunds processed for the referred customer.

4.4.5. If our payment processor charges any payment processing or transfer fees related to the commission payouts, you are responsible for paying these fees.

4.4.6. MailerLite processes payouts within 45 days of a valid request, unless your account is under review for fraud, policy violation, or other compliance issues.

4.4.7. If the total commission payout requested by the Affiliate exceeds 10,000 USD, MailerLite reserves the right, at its sole discretion, to divide the requested amount into multiple payments over subsequent payout periods. This right is reserved for internal financial planning and capacity requirements and may be exercised even if the Affiliate requested the full amount in a single claim. Processing of the divided amounts may exceed the general payout timeline of 45 days per payment cycle.

4.5. Chargebacks & Reversals

4.5.1. If an active paying customer cancels their subscription, receives a refund, or initiates a chargeback, any previously paid commission related to that transaction may be deducted from your future payouts or offset against your affiliate balance.

4.5.2. MailerLite reserves the right to claw back commissions in cases of:

  • Fraudulent or misleading marketing practices;

  • Breach of these Terms;

  • Use of unauthorized discount codes or affiliate IDs;

  • Active paying customers failing to meet the Program’s criteria.

4.5.3 MailerLite reserves the right to adjust Affiliate Commissions based on the final status of the referred customer's payment (including but not limited to the cases described in 4.5.1 and 4.5.2). Within the tracking system:

  • If a customer receives a full refund for a purchase, the corresponding commission transaction will be marked as refunded, and the full associated commission will be deducted or offset from the Affiliate's balance.

  • If a customer receives a partial refund, a corresponding negative adjustment transaction equal to the commission amount associated with the refund will be generated in the tracking system. This negative adjustment will be deducted from the Affiliate's balance.

4.6. Disputed Commissions

If you believe a commission has not been properly credited to your account, you must submit a written dispute within thirty (30) days of the transaction date. Include relevant documentation and a clear description of the issue. MailerLite reserves the right to not consider disputes that are submitted beyond this period.

4.7. Inactive Accounts
  • Your account is considered inactive if you have no login to your Affiliate Dashboard within the past thirty-six (36) months and no new sales within the past twelve (12) consecutive months (“Inactive Account”).

  • If your account remains inactive, your affiliate status may be revoked, your account marked dormant and scheduled for a deletion.

  • All accumulated commissions unclaimed for more than twenty-four (24) months will be permanently forfeited, with no option for recovery.

5. Termination and Modification

5.1. Voluntary Termination

Either you or we may end this Affiliate Program at any time, with or without cause, by giving the other party a written notice. Written notice shall be in the form of an email.

5.2. Termination for Violations

If you fail to follow the terms and conditions of this document, we reserve the right to terminate your participation in the MailerLite Affiliate Program. We will do everything possible to contact the Affiliate prior to the ban. 5.3. Modification Rights

6. Promotional Restrictions

6.1. Email Marketing Guidelines

Additionally, affiliates may not display any offer code on publicly accessible pages or use methods like ‘Click to Display’ to reveal an offer code. 10-1. Migration Terms

Due to the necessary system finalization and capacity planning associated with the migration, processing all outstanding commissions may take up to 180 days.

a) New TrackDesk Account

You will receive an email from MailerLite containing a special link to log into your new TrackDesk dashboard. You have to follow the instructions in that email to complete your new account setup and password update. Your existing Affiliate Links will remain functional throughout the migration.
