These Education Cohort Terms (hereinafter, “Terms”) apply to all selected MailerLite customers (hereinafter, “Customer”) and determine the purpose, process, and other details related to the 6-week educational pilot program (hereinafter, “Cohort”).
1. Purpose
1.1. The purpose of the Cohort is to provide strategic guidance on email list growth, automation implementation, and conversion optimization to help Customers achieve their business goals while gathering participant insights to help improve MailerLite products and services.
2. Participation and Selection
2.1. The Cohort is a free, 6-week pilot program. Participation is voluntary and does not modify the Customer’s existing subscription terms with MailerLite.
2.2. Participants are selected through an application process after the potential participant fills in this registration form. MailerLite reserves the right, at its sole discretion, to select participants based on program fit.
2.3. Applying for the Cohort does not guarantee selection. Non-selection does not impact the Customer’s standing or access to MailerLite services.
3. Program Structure and Conduct
3.1. The Cohort will be conducted via the Circle platform and live digital meeting tools.
3.2. By participating, the Customer acknowledges that they will be required to sign up on the Circle platform through their MailerLite account. The Customer's use of Circle is subject to Circle’s own terms of service and privacy policy. The Customer provides any information or data to the Circle platform at their own responsibility and risk. MailerLite is not responsible for the data security, privacy practices, or technical availability of the Circle platform.
3.3. Participants are expected to engage respectfully within the private community channel. MailerLite reserves the right to remove any participant from the Cohort or Circle community at any time for conduct that is disruptive or violates MailerLite’s general Terms of Use.
3.4. While the program includes weekly tasks and milestones, there is no official legal obligation for completion. MailerLite provides no guarantee of specific business results, list growth, or revenue increases following participation.
3.5. The Cohort is an educational pilot facilitated by MailerLite. The instruction provided during the Cohort does not constitute professional, legal, or financial advice. Any strategies, templates, or suggestions implemented by the Customer are done so at their own risk and based on their own professional judgment. MailerLite is not responsible for any impact on the Customer’s business operations or email performance resulting from the application of Cohort materials.
4. Intellectual Property and Use of Feedback
4.1. MailerLite retains all rights, titles, and interests in any educational materials, templates, worksheets, or recordings provided during the Cohort. MailerLite reserves the right to modify the schedule or content of the program at any time.
4.2. By participating, the Customer agrees that MailerLite may use any feedback, suggestions, or business challenges shared during the Cohort (hereinafter, “Feedback”) for internal product development and marketing research without compensation.
4.3. By participating, the Customer grants MailerLite a non-exclusive, worldwide, royalty-free license to use any content, testimonials, or success metrics shared within the Cohort community for marketing and promotional purposes. This includes, but is not limited to, use in social media, case studies, and email campaigns. MailerLite may identify the Customer by their business name and use their logo as part of these promotional materials without requiring further prior approval provided that such use is a fair and accurate representation of the Customer's participation.
5. Confidentiality
5.1. During the Cohort, the Customer may be exposed to the business data, strategies, or private information of other participants. The Customer agrees to maintain the confidentiality of peer participants and shall not disclose such information outside of the Cohort. However, MailerLite cannot be held liable if one participant discloses another participant's information.
5.2. MailerLite will treat any sensitive business information shared by the Customer as confidential and will only use it for the purposes of facilitating the Cohort and internal product research.
6. Recording and Privacy
6.1. Live sessions may be recorded for the benefit of Cohort members. By joining a recorded session, the Customer consents to the recording of their voice and image.
6.2. Please read MailerLite’s Privacy Policy to learn more about how we process and protect personal data.
6.3. By applying for the Cohort, the Customer agrees that MailerLite is allowed to process the personal data provided in the application for the purpose of managing the Cohort and communicating program updates.
6.4. By agreeing to these terms, the Customer gives MailerLite their consent to stay in touch with them as a Cohort Member after the program ends to track long-term progress, share product updates, or invite the Customer to participate in further research, community initiatives, or focus groups. The Customer may withdraw this consent or opt-out of these communications at any time by contacting MailerLite or using the unsubscribe link provided in such communications.
7. Limitation of Liability
7.1. To the maximum extent permitted by law, MailerLite shall not be liable for any direct, indirect, incidental, or consequential damages resulting from participation in the Cohort or the use of materials provided during the program.
8. Disputes
8.1. Negotiations shall settle any disputes arising from participation in the Cohort. Any dispute, controversy, or claim arising out of or in connection with the Cohort shall be finally settled by the courts of the jurisdiction applicable to the MailerLite entity responsible for providing services to the Customer.
9. Miscellaneous provisions
9.1. If, for any reason, the Cohort is not capable of running as planned, it may be terminated at MailerLite’s sole discretion.
9.2. In the event of a conflict between these Terms and any instructions or interpretation of these Terms regarding the participation in the Cohort, these Terms shall prevail.
9.3. These Terms are subject to change at MailerLite’s sole discretion. If MailerLite decides to change these Terms, all changes will be posted on this page. All changes are effective immediately upon posting and we suggest that the Customer check these Terms periodically.
