MailerLite promotes a sponsorship initiative under which nonprofit organizations can receive complimentary use of the MailerLite platform for 2 years, upon being invited by MailerLite or submitting a sponsorship application (“Sponsorship”), according to the terms and conditions stipulated in these Terms (“Terms”).
1. Eligibility
1.1. The nonprofit organization ("Organization") must be officially registered and recognized as a nonprofit entity by the relevant governmental authority. Proof of nonprofit status is required, unless the Organization has previously signed up to get a 30% discount and/or created an account in MailerLite’s platform and already provided relevant proof.
1.2. The Sponsorship is applied only to the New MailerLite platform. If the Organization is currently using the MailerLite Classic application, the Organization will first need to migrate to the New MailerLite. In case the Organization has any questions and/or issues related to the migration, the Organization shall contact MailerLite's Support Team.
1.3. The Organization’s account must comply with MailerLite’s Terms of Use and Terms of Service.
2. Exclusions
2.1. The Sponsorship is not available to MailerLite Classic plans; to any individuals associated with MailerLite, including employees, service providers, agents, or representatives of MailerLite; or where participation is prohibited or restricted by national or local law.
3. Sponsorship Procedure
3.1. To participate in this Sponsorship, the Organization should either fill in a contact form, requesting to be a Sponsored Organization, or be suggested internally for sponsorship by MailerLite. Both the submission of a sponsorship application and an internal suggestion add the Organization to a shortlist from which MailerLite can choose an Organization to sponsor. The Organization will receive complementary use of MailerLite services for a period of 2 years only if MailerLite chooses to sponsor the Organization. If the Organization is not chosen, the Organization is still eligible for a 30% discount on MailerLite's services. The 30% discount cannot be stacked with any other discounts.
3.2. If the Organization is chosen by MailerLite, MailerLite will contact the Organization with the email address under which their account is registered or which they submitted through the contact form. The Organization should expect to be contacted within 30 days of the request being submitted or, if the Organization was suggested internally, within 30 days of the suggestion. If the Organization is not contacted within 30 days as specified in this Clause, it means that the Organization was not chosen by MailerLite.
3.3. If the Organization has any type of paid yearly subscription when they accept the sponsorship, the sponsorship starts immediately, and the remainder of their paid yearly plan is transferred as MailerLite credits to their sponsored account.
4. Branding requirement
4.1. In order to retain its sponsorship, the Organization will need to incorporate the automatically applied MailerLite sponsorship badge (“Badge”) into all email templates that were created with the Organization’s sponsored MailerLite account. MailerLite might also implement the Badge into the templates of pop-ups and/or landing pages created with the Organization’s sponsored MailerLite account. In such cases, the Badge will be incorporated in the Organization’s pop-ups and/or landing pages.
4.2. If requested by MailerLite, MailerLite’s logo shall also be displayed on the Organization’s website, for the purposes of publicly representing that the Organization is being sponsored by MailerLite.
4.3. Obligations specified in Clauses 4.1 and 4.2 apply to the Organization throughout the whole sponsorship period, unless MailerLite specifically states in writing otherwise.
5. Advertisement
5.1. By being a sponsored organization, the Organization agrees to submit testimonials and participate in case studies for MailerLite. The Organization gives permission to showcase it in MailerLite’s marketing materials, including blog posts, social media posts, and any paid advertising. In case the Organization is not responsive to such outreach, MailerLite reserves the right to terminate the Sponsorship as per Clause 9.2 of these Terms.
5.2. By agreeing with these Terms, the Organization also gives explicit consent for MailerLite to display the Organization’s logo on MailerLite’s website during and after the sponsorship to publicly advertise the relationship between MailerLite and the Organization. The Organization can withdraw such consent at any time by emailing MailerLite at community@mailerlite.com.
6. Sponsorship Period
6.1. The Organization is granted free access to the MailerLite Advanced plan for a period of 2 years. The 2-year period starts on the day when MailerLite decides to sponsor the account and sends a confirmation email to the Organization.
6.2. Upon the expiration of the Sponsorship period, the Organization can participate in the Sponsorship application process once again by contacting MailerLite. If the Organization is not re-selected as MailerLite’s Sponsorship beneficiary, the Organization is transferred back to the paid subscription plan that it had before the sponsorship. In case of such transfer, a 30% discount may be applied to the Organization’s subscription price.
7. Scope of Use
7.1. The Organization’s MailerLite account can only be used for purposes directly related to the Organization's nonprofit activities. Any usage beyond the scope of the Organization's charitable or educational objectives is prohibited.
8. Support and Maintenance
8.1. MailerLite‘s customer support and maintenance services are provided to assist with technical issues and inquiries related to the Organization’s account. However, the extent and level of support may vary and are subject to change at MailerLite’s discretion.
9. Termination of Services
9.1. MailerLite reserves the right to terminate or suspend the Organization's access to the MailerLite platform at any time for violation of MailerLite’s Terms of Use, Terms of Service, or any other reason deemed necessary by MailerLite, including violation of these Terms, without any refund.
9.2. MailerLite reserves the right to immediately revoke the Organization’s Sponsorship without giving prior notice if the Organization does not in any way respond to MailerLite’s outreach and communication for more than 6 (six) consecutive months.
10. Miscellaneous Provisions
10.1. MailerLite reserves the right to terminate or modify the Sponsorship or these Terms at any time at its sole discretion.
10.2. In the event of a conflict between these Terms and any instructions or interpretation of these Terms regarding the Sponsorship, these Terms shall prevail.
10.3. Any disputes arising out of or in connection with these Terms shall be resolved by the courts of the jurisdiction applicable to the MailerLite entity responsible for providing services in the Organization’s billing address country.
By being sponsored by MailerLite, you acknowledge and agree to comply with these Terms and any modifications or updates provided by MailerLite.
